IP / Copyright Policy (Notice & Takedown)

Effective Date: September 13, 2025 · Applies to: Journory App (iOS/Android) & Website journory.com
Contact (Legal Authorities & Reports): legal@journory.com
Preferred languages: EN/DE

1) Purpose & Scope

This policy describes the procedure by which rights holders or their authorized representatives may report allegedly infringing content (“Notice”), as well as the appeal/counter-notice process for affected users.
We implement a DSA-compliant notice-and-action procedure (EU) and apply the principles globally in a consistent manner.

2) How to Submit a Notice of Infringement

Send an email to legal@journory.com or use the in-app reporting function. Please include the following information:

  • Identification of the protected work/right (title, type, trademark/registration number, affected person, etc.)
  • Location of the content (precise link, ID, screenshot, upload date/time)
  • Description of the infringement (e.g. lack of license, unauthorized use)
  • Rights holder and, if applicable, authorization of representative (with proof)
  • Statement made in good faith that the information is accurate and that you are authorized to make the notice
  • Requested action (e.g. removal, blocking, geo-restriction)
  • Date & signature (text form sufficient)

Note: Incomplete notices may not be processed or may be delayed.

3) Review & Actions

  • Receipt & Confirmation: We generally acknowledge notices within 5 business days.
  • Assessment: We review the matter considering the rights chain, exceptions (quotation, parody, reporting, fair use equivalents), and licenses.
  • Actions: Removal, blocking, geo-restriction, anonymization, or rejection (with reasons).
  • Transparency: We inform the parties involved about decisions, as far as legally permissible.

4) Counter-Notice / Appeal

If you are a user affected by removal/blocking, you may file a counter-notice within 14 days (reply to our notification or send to legal@journory.com):

  • Identification of the removed content (link/ID/screenshot)
  • Reasoning (e.g. license proof, authorship, statutory exception)
  • Contact details for clarification
  • Statement that your information is accurate and that no infringement exists

5) Repeat Infringer Policy

  • Step model: Warning → temporary suspension → account termination for repeated or severe infringements.
  • Abuse prevention: False or malicious notices/counter-notices may be rejected and further measures applied.

6) Special Cases

  • Trademarks: Please provide registration number/certificate.
  • Personality/Image rights: Please specify concrete harm (e.g. identifiability, context, consent).
  • Minors & sensitive content: We act promptly in compliance with applicable law.

7) Disclosure & Data Protection

We may share parts of your notice (including contact details) with the affected uploader, where necessary. Notices/counter-notices are stored for compliance and evidence purposes (generally 3–6 years). See our Privacy Policy for further details.

8) Liability & No Legal Advice

We make decisions to the best of our knowledge and under applicable laws, but we do not provide legal advice. Please consult a lawyer if you require legal counsel.

9) Abuse & Sanctions

Submitting false or misleading notices/counter-notices may result in civil or criminal liability. We reserve the right to claim reimbursement of costs for abusive use, as permitted by law.

10) Changes to this Policy

We may adjust this policy to reflect legal developments and internal processes. The current version is always available in the app and on our website.
